Terms of Service

Welcome to Dex! These Terms of Service ("Terms") govern your access to and use of our app and website:

These Terms form a legally binding agreement between you ("you" or "the user") and Dexbit Lda ("Dex", "we", or "us"). Please read them carefully before using the Services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Services.

1. Intellectual Property Disclaimer

All text, images, and other materials related to the Pokémon Trading Card Game, including card images, trademarks, and logos, are copyrighted or trademarked properties of The Pokémon Company.

Dex is an independent application and is not produced, endorsed, supported, or affiliated with The Pokémon Company International. Any references to Pokémon content are used for informational / reference purposes only.

2. Eligibility and Age Requirements

You must be at least 13 years old to use the Services. If you are under 18, you must have permission from a parent or legal guardian. Parents or guardians are responsible for monitoring use by minors.

3. Account Registration

Some features of the Services require an account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Accept responsibility for all activity under your account

You may not share your account or transfer it without our permission. If you believe your account has been compromised, contact us immediately.

4. Acceptable Use

We grant you a limited, non-exclusive, revocable license to use the Services for personal, non-commercial purposes. You agree not to:

  • Copy, modify, reverse-engineer, or distribute the Services
  • Use the Services for any unlawful purpose
  • Interfere with or disrupt the Services or their security

5. Payment Terms

Certain features may require payment (e.g., Dex+ subscriptions). Payment is processed via third-party providers such as RevenueCat. By subscribing, you agree to their terms as well.

All payments are non-refundable unless explicitly stated otherwise.

6. Termination

We may suspend or terminate your access to the Services at any time for violations of these Terms or for any other reason. Upon termination, your license is revoked and you must stop using the Services.

Any attempt to circumvent, bypass, or otherwise gain unauthorized access to paid features (e.g., hacking or exploiting the app to unlock premium content without payment) constitutes a serious violation of these Terms and will result in an immediate and permanent ban from all of our Services, without prior notice or liability.

7. Third-Party Services

The Services may include links or integrations with third-party services. Dex is not responsible for the content, availability, or practices of third parties. Your use of such services is at your own risk and governed by their respective terms and policies.

8. App Store Terms

If you download the app from the Apple App Store, your use is also subject to Apple's applicable terms and conditions. You agree to comply with such terms.

9. Modifications to the Services

We may update, modify, or discontinue any part of the Services at any time. We will attempt to notify users of significant changes but are not obligated to do so.

10. Changes to Terms

We may update these Terms at any time. Updates will be posted on this page and will include a new effective date. Continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.

11. Disclaimer of Warranties

The Services are provided "as is" and "as available," without warranty of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or meet your expectations.

12. Limitation of Liability

To the fullest extent permitted by law, Dex shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including loss of data or profits.

13. Indemnification

You agree to indemnify and hold Dex harmless from any claims, damages, losses, or expenses (including legal fees) resulting from your violation of these Terms or misuse of the Services.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal. Any disputes arising under or related to these Terms will be subject to the exclusive jurisdiction of the courts of Portugal.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the rest of the Terms will remain in full force and effect.

16. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Dex regarding the Services. They supersede all prior agreements, written or oral.
